    Australian Institute of Holistic Medicine has withdrawn its Graduate Vocational Diploma of Acupuncture from assessment

    Endeavour College of Natural Health has submitted a variation application for assessment of its approved Bachelor of Health Science (Acupuncture) delivered at its Adelaide and Perth campuses

    Policy and Guideline Updates

    Following consultation with the profession the Board has ratified the Guidelines for the Practice of Chinese Herbal Medicine including Schedule 1 Herbs.

    The Board has made minor revision to the Policy and guidelines on practitioner supervision to make it clear that the guideline can be applied to volunatary supervision arrangements.

    National Registration - Application Forms Now Available!
    The Chinese Medicine Board of Australia have now posted the application forms for national registration on their website.

    Already registered with the CMRBV?
    • Practitioners registered with this Board (Chinese Medicine Registration Board of Victoria) DO NOT NEED TO APPLY to the National Board for registration.
    • If you are registered with the Victorian Board as at 30 June 2012 you will automatically transition over to the national scheme.
    • To check that you are registered with the Chinese Medicine Registration Board of Victoria and will therefore transition, search the Victorian Register here: http://www.cmrb.vic.gov.au/practitionersearch/registersearch.php


    New to Chinese medicine registration?
    • All other Chinese Medicine practitioners (i.e. those NOT already registered with the Chinese Medicine Registration Board of Victoria) MUST apply directly to the National Board for registration.

    National Board - Consultation Documents
    The Chinese Medicine Board of Australia (the National Board) has released a consultation paper on proposed registration standards for;
    1. A code of conduct for the profession
    2. Guidelines on mandatory reporting
    3. Guidelines on Advertising
    4. Guidelines for Patient Records

    In addition, the National Board has released a consultation paper on the composition of its Accreditation Committee.

    Consultation on Acupuncture Standard for Endorsed Professions

    The Australian Physiotherapy Council is inviting submissions from key stakeholders as part of a broad consultation (Stage 2) on the draft accreditation standard for the assessment of programs of study relevant to the endorsement of a registered health practitioner to practice as an acupuncturist. The consultation is being conducted in accordance with the Australian Health Practitioner Regulation Agency document "Procedures for development of accreditation standards". Following the close of the consultation the responses will be considered and the document will be revised. The revised standard will be submitted to the participating National Boards for approval.

    A revised version of the Guidelines on the Approval of Courses of Study is now posted.

    The Board now releases a new version of the Guidelines for the approval of courses of study as a qualification for registration, which incorporates the requirements for approval of courses in:
    • Chinese herbal dispensing; and
    • Schedule 1 herb training.

    National Board - Consultation Documents
    The Chinese Medicine Board of Australia (the National Board) has released a consultation paper on proposed registration standards for;
    1. Continuing professional development
    2. Criminal history
    3. English language skills
    4. Professional indemnity insurance (PII)
    5. Recency of practice

    In addition, the National Board is also consulting on a draft grand-parenting registration standard.

    URGENT RENEWAL OF REGISTRATION IS DUE NOW

    A compliant renewal must be submitted by 30 June 2011 or a late fee will apply.

    A compliant renewal application for practising practitioners is:
    - a correctly completed renewal form
    - the correct renewal fee
    - evidence of professional indemnity insurance that meets the Board's requirements
    - the Workforce Data Survey

    A compliant renewal application for non-practising practitioners is:
    - a correctly completed renewal form
    - the correct renewal fee
    - the Workforce Data Survey

    If your application is non-compliant the staff are required to return the relevant parts to you for correction, if the relevant documents are not returned by 30 June 2011 a late fee will apply. Therefore please allow time for this process.

    Updated Course Approvals

    Endeavour College of Natural Health has been granted PROVISIONAL approval with conditions of its new Bachelor of Health Sciences (Acupuncture) course.

    RMIT has been granted PROVISIONAL approval of its Bachelor Health Science (Acupuncture and Chinese Manual Therapy)course.

    Provisional approval may be granted where the course meets all the Board’s requirements but there are not yet any graduates of the course; or where full compliance with the Board’s specified Standards has not yet been fully demonstrated.

    Alert for Chinese medicine practitioners - Application Form from Medical Register of Australia
    It has come to the attention of Chinese Medicine Registration Board of Victoria (CMR Board) that letters and application forms are being sent out by an organisation, The Medical Register of Australia. Their correspondence may lead you to believe that registration with them is required to comply with the Health Professions Registration Act 2005 or the Health Practitioner Regulation National Law Act 2009.

    This is not the case. Neither CMRB nor Australian Health Practitioner Regulation Agency (AHPRA) requires you to apply for registration with the Medical Register of Australia to be recognised as a registered health practitioner.

    The Medical Register of Australia is a separate organisation. It has no role or relationship to the CMR Board, AHPRA, any of the National Boards or the National Registration and Accreditation Scheme.

    Guidelines for profession indemnity insurance - updated
    The following addition has been made to the professional indemnity insurance guidelines:

    Registered practitioners who have insurance with an insurer who is not registered in Australia are required to provide a copy of the full wording of the policy to be assessed by an appropriately qualified person at the practitioner's expense.

    Clarification on approval of courses for Endeavour College of Natural Health

    Teach out version of Bachelor course, is GRANTED PROVISIONAL APPROVAL till end 2011, subject to the condition that data on student enrolments and attrition be actively monitored by ECNH and annual reports provided to the CMR Board. CMR Board approval only applies to the course as delivered in Victoria and Queensland.

    New Bachelor course is currently under consideration by the CMR Board.

    The Board is steadfast in its efforts to protect the public. The Board relies on patients reporting suspect conduct so that it can take appropriate action. This long investigation into Mr Woo’s conduct involved 3 patients spanning 10 years. Patients trust that any treatment recommended to them by their practitioner is in their best interests, has therapeutic justification and will not cause harm. Using a patient for personal, sexual gratification is totally reprehensible and one of the worst breaches of trust. The Board is satisfied with the Tribunal’s determination that Mr Woo’s character is deficient and that the public needs to be protected through cancellation of his registration.

    The Board’s primary obligation is to protect the public. This decision confirms that practitioners will be held to account, by the law and their peers, should they place their own interests or needs ahead of a patient’s welfare. Patients are vulnerable when seeking medical assistance – to take advantage of this imbalance of power is exploitive and potentially harmful. Sexual contact with patients interferes with a practitioner’s objective judgment and erodes the public’s trust in the profession. Patients should not fear they will be preyed upon or subjected to sexualised treatment in a clinical setting.

    Health Practitioner Regulation National Law (Victoria) Act 2009
    The final Bill (Bill 2 of Bill C) to implement the national scheme passed the Legislative Council of Parliament on the afternoon of 25 March 2010. Victoria is the first 'big' state to have passed the last piece of legislation to join the national scheme on 1 July 2010.

    Scheduled herbs to be accessible to Chinese medicine practitioners
    The Hon Daniel Andrews, Victorian, Minister for Health, has approved the insertion of an initial three recommended Chinese herbs into Schedule 1 of the Poisons List. This marks a successful end to one of the Board's biggest and most challenging projects since the commencement of the Chinese Medicine Registration Act 2000.

    The next step is for the Department of Health to add the Chinese herbs, ban bian lian, zhi fu zhi and ma huang to Schedule 1 of the Poisons List of the Poisons Code per the Victorian Drugs Poisons and Controlled Substances Act 1981. These are all established Chinese herbal medicines, each of which has therapeutic value and no satisfactory substitutes. Once this happens the Board will embark upon the next major project of implementation.

    National Registration
    The National registration scheme commences on 1 July 2010 (not including Chinese medicine) and the Health Practitioner Regulation National Law (Victoria) Bill received Royal Assent on 8 December 2009 and is now an Act. Chinese medicine comes into the scheme on 1 July 2012.

    Chinese Medicine Workforce Report

    A report of the 2008 and 2009 Victorian Chinese Medicine Labour Force Survey prepared by the Workforce Unit of the Department of Health is now available. The survey explored the profile of the Chinese medicine workforce within Victoria, and the report provides an understanding of the workforce characteristics and practice within the profession in Victoria.

    National registration - the new legislation
    The Ministerial Council on 12 June released the exposure draft of the Health Practitioner Regulation National Law 2009. The exposure draft sets out the legal framework for the new National Registration and Accreditation Scheme for the Health Professions, which begins on 1 July 2010.

    The exposure draft is being released to enable further comment from the public, health practitioners and current registration boards prior to the Bill’s introduction into the Queensland Parliament. Following passage in the Queensland Parliament, draft legislation will be introduced in all parliaments across Australia to adopt the new National Law.

    Code of Ethics

    After a long period of consideration and consultation the Board has published its Code of Ethics. The Board has taken an approach somewhat different to the standard codes we are all familar with. This document was formulated to assist practitioners to reflect on the ethical dimensions of their work and to address the question of what it means to be an ethically sound, professional Chinese medicine practitioner.

    Chinese Medicine included in new national registration and accreditation scheme

    The Australian Health Workforce Ministerial Council has today reached a national consensus on how the new National Registration and Accreditation Scheme for the Health Professions will work. This will deliver improvements to the safety and quality of Australia’s health services through a modernised national regulatory system for health practitioners.

    The Council also decided that, from 1 July 2012, Aboriginal and Torres Strait Islander health practitioners, Chinese medicine practitioners and medical radiation practitioners will be regulated under the scheme.

    Ministers also decided that the national office of the new Australian Health Practitioner Regulation Agency will be located in Melbourne.
